【讲座提要】The Universal Declaration of Human Rights (UDHR) outlines the normative foundation for the international human rights regime. In a context of pluralistic interpretations it would be interesting to return to the normative foundation and take a closer look at the UDHR.Our analysis will then fall in three parts. After a short enquiry into the sources of the declaration we will firstly deploy a distinction between permissive and perfectionist rights. Secondly we will take the declaration at face value in order to see what emerges from the text itself. In the third part of our analysis we will take a closer look at the drafters and we will finally conclude that the examination of the drafters' views consolidates our interpretation of the text, even though it has to be explained as an overlapping consensus between two types of perfectionism. This result will be underpinned further by a worldwide survey of the types of government and their ideology, in order to make clear how a perfectionist declaration was possible at the time.
